The Ministry of Finance, through the Prize and Betting Secretariat, published in the Official Gazette of the Union, Ordinance No. 1207, which establishes technical criteria for online gambling games, such as “Jogo do Tigrinho”. The Government classifies games in this category as those in which “the result is determined by the outcome of a random future event, based on a random generator of numbers, symbols, figures or objects defined in the rules system.”
This segment does not include, for example, sports betting platforms, which the Government classifies as “multi-bettor games”, in which “the actions of the bettor or the results obtained by him are influenced by the result or action of any other bettor.”
The new ordinance authorizes the operation of games of this type in the country, as long as they comply with the newly established rules.
To do so, those responsible for the games must request authorization from the Ministry of Finance. Subsequently, they will be analyzed by authorized certifiers to determine whether they comply with the rules. So far, five companies have submitted the request at the federal level. They are: 1) Kaizen Gaming Brasil Ltda; 2) Sprbtbr Ltda; 3) MMD Tecnologia, Entretenimento e Marketing Ltda; 4) Ventmear Brasil S.A., and 5) Big Brazil Tecnologia e Loteria S.A.
MAIN RULES
According to the new ordinance, games must make available to users, at the time of placing a bet, the multiplication factor for each real bet, so that the amount that the bettor will receive in case of victory is defined.
Before placing a bet, the game must present the bettor with the payout tables, with information on all the possibilities of winning that he/she will have. The value of the prize must not be changed after the bet has been placed.
The game’s graphics must clearly explain to the bettor how to win. This explanation must include the order and quantity of symbols necessary for winning.
Moreover, the publication determines that the betting session must be considered closed after 30 minutes of inactivity by the player on the platform.
Besides, the Ministry of Finance prohibits online betting games from being offered in physical environments, through electronic devices.
