Exclusive: LOTBA launches new Informative Circular for online gaming process

The Buenos Aires City Lottery is including specific and important information for interested operators.

In response to inquiries from firms seeking to become Online Gambling Agencies in the jurisdiction, Buenos Aires City Lottery established a series of guidelines through a new document.

Through its president Martin Garcia Santillan, the Lottery of the City of Buenos Aires, Argentina, drafted Circular DI-2020-509 #1 and its Addendum (check here: https://www.loteriadelaciudad.gob.ar/NormativaJuegoenLinea/) in order to answer and clarify different queries from companies interested in obtaining a permit to be an Online Gaming Agency in the territory.

The requests were received through the Self-Management Platform and were related to different conditions and procedures involved in some articles of Directory Resolution #15-LOTBA/20 on the Call for the granting of permits for Online Gambling Agencies.

To answer these requests, the new Circular and its Addendum clarify a Banco Ciudad account number to deposit the payments indicated in the regulations, as well as tells that companies will be able to present as: a) a legal entity that is an Argentine branch of a parent company; b) two or more legal entities that form a Transitory Union; and c) a legal person that appears as part of a business group.

Moreover, the Informative Circular also considers the need for the selected Agencies to make tests in order to guarantee the security of all the software, hardware, information, databases, links and processes of the Technical System in accordance with international standards. These tests “must be certified by one of the entities that belong to the LOTBA’s Laboratory Register and must be carried out at least once a year, and the results must be reported to LOTBA afterwards.” On the one hand, each Online Gaming Agency will have to keep available online the information of all its technical system and SCI for the last two years, and the rest of the information on backup devices. On the other hand, “the Certifying Laboratory must verify that: a) In the last two years, the technical gaming system has passed a penetration test and a vulnerability analysis; and b) There is an analysis plan of vulnerabilities, at least once in a year.”
